Service and Usage Agreement
This Service and Usage Agreement ("Agreement") is entered into between Shamshost.com ("Shamshost") and the user ("User") of Shamshost's services. By accessing or using any services provided by Shamshost, the User agrees to be bound by the terms and conditions outlined in this Agreement.
1. Service Provision
1.1. Shamshost agrees to provide web hosting, domain registration, and related services ("Services") to the User, subject to the terms and conditions of this Agreement.
1.2. The User acknowledges that Shamshost may modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.
2. User Obligations
2.1. The User agrees to use the Services in compliance with all applicable laws and regulations.
2.2. The User is solely responsible for the content they upload, store, or distribute using the Services. The User agrees not to upload, post, or transmit any content that violates any laws, infringes on any intellectual property rights, or is otherwise offensive or harmful.
2.3. The User agrees not to engage in any activity that may disrupt or interfere with the proper functioning of the Services or the servers hosting the Services.
3. Payment and Billing
3.1. The User agrees to pay all fees associated with the Services in a timely manner, as outlined in the pricing plans provided by Shamshost.
3.2. Shamshost reserves the right to suspend or terminate the User's access to the Services in the event of non-payment.
4. Privacy and Data Security
4.1. Shamshost agrees to take reasonable measures to protect the privacy and security of the User's data.
4.2. The User acknowledges that Shamshost may collect and process personal information as necessary to provide the Services, and agrees to the terms of Shamshost's Privacy Policy.
5. Limitation of Liability
5.1. Shamshost shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Services, even if Shamshost has been advised of the possibility of such damages.
5.2. In no event shall Shamshost's total liability to the User exceed the total amount paid by the User for the Services during the twelve-month period immediately preceding the event giving rise to the liability.
6. Termination
6.1. Either party may terminate this Agreement at any time with or without cause upon written notice to the other party.
6.2. Upon termination of this Agreement, the User's access to the Services will be terminated, and any outstanding fees shall become immediately due and payable.
7. Governing Law
7.1. This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles.
8. Miscellaneous
8.1. This Agreement constitutes the entire agreement between Shamshost and the User with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral.
8.2. Shamshost may update or modify this Agreement from time to time, and such updates or modifications shall be effective upon posting on Shamshost's website.
9.1. The User acknowledges that the resources provided by Shamshost, including but not limited to bandwidth, disk space, and processing power, are shared among multiple users.
9.2. The User agrees to utilize these resources responsibly and fairly, avoiding excessive consumption that may negatively impact other users' access to the Services.
9.3. Shamshost reserves the right to monitor resource usage and take appropriate action, including but not limited to suspending or terminating the User's access to the Services, if the User's usage is deemed excessive or abusive.
9.4. Any determinations regarding fair usage shall be made at the sole discretion of Shamshost and shall be final.
By using Shamshost's Services, the User acknowledges that they have read, understood, and agree to be bound by the terms and conditions of this Agreement.
